The Divorce/Dissolution Proceedings Explained



Under current divorce/dissolution proceedings in England and Wales, the application is based on a no-fault system, meaning neither party needs to prove wrongdoing. The process typically involves the following stages:


  • Application for Divorce/Dissolution – One or both spouses submit an application through the court portal confirming the  marriage has irretrievably broken down.
  • Acknowledgement – The other spouse confirms receipt of the application.
  • Conditional Order – After a minimum period of 20 weeks, the court confirms there is no legal reason the divorce cannot proceed.
  • Final Order – After a further waiting period of at least 6 weeks following the pronouncement of the conditional order, the court legally ends the marriage/civil partnership.

How Long Does Divorce/Dissolution Take?



A straightforward divorce/dissolution usually takes a minimum of six months from application to Final Order. The process will take longer if there are disputes relating to finances, property, pensions, child arrangements, or lack of cooperation. Financial Matters and Children


The majority of divorces/dissolutions involve consideration of the family's financial arrangements, these include deciding how to divide the family home and savings, division of pensions, and possibly one spouse paying the other maintenance.

The ideal solution is for both parties to reach an amicable financial agreement through negotiation between both parties and their divorce solicitors, or with the assistance of mediation.  Reaching an agreement by consent can reduce legal fees and avoid the necessity of going to Court.

Where children are involved, arrangements must be made concerning living arrangements, time with each parent, and decisions relating to education and welfare.
